Frequently Asked Questions

What is the Retail Leases Act and does it apply to my lease?

The Retail Leases Act 2003 (Vic) applies to most retail premises in Victoria where the tenant occupies less than 1,000 square metres. It provides tenants with important protections around disclosure, rent reviews, outgoings, lease renewal and dispute resolution. We can advise whether your lease falls within the Act and what rights it gives you.

What is a make-good clause and why does it matter?

A make-good clause requires the tenant to restore the premises to a specified condition at the end of the lease. This can be very expensive if it requires removing fit-out, repairing damage or repainting. It is important to negotiate the scope of this obligation before you sign, as the cost of compliance at lease end can be significant.

Can I get out of my lease early?

That depends on the terms of your lease. Some leases include a break clause or early termination option. If yours does not, you may still be able to negotiate an exit with the landlord, assign the lease to a new tenant, or in some cases rely on specific provisions of the Retail Leases Act. We can review your options based on your specific lease terms.
